Introduction

The Fair Work Commission can't give you advice about your legal rights and obligations, or provide you with detailed information about how work should be organised in your workplace.

However some places to find information are listed below:

  • alleged breaches of pay and conditions
  • consultation
  • performance management
  • policies, processes and procedures
  • recruitment and selection
  • workplace culture

Alleged breaches of pay & conditions

The Commission does not investigate allegations of breaches of pay and conditions in the workplace.

You can contact the Fair Work Ombudsman regarding:

  • not being paid the right amount
  • not getting the right amount of leave or other conditions
  • being threatened by your employer
  • being discriminated against
  • sham contracting.

Visit the Fair Work Ombudsman's Consultation & cooperation page for detailed information about best practice consultation in the workplace.

Performance management

The Commission can't give you advice on performance management, or setting up performance management systems in your workplace.

Below are some places to go for information and guides:

  • the Fair Work Ombudsman's guide to underperformance with a checklist (PDF)
  • Business Victoria's Review staff performance section of its website has information on performance reviews and key performance indicators

Policies, processes & procedures

Workplaces can develop policies and procedures for matters including:

  • recruitment and selection
  • flexible working arrangements
  • performance management
  • internet usage, and
  • hospitality and travel.

The Commission can't provide you with advice about writing workplace policies, processes and procedures.

The Fair Work Ombudsman provides a number of best practice guides for employers about how to create and implement policies and procedures in the workplace.

Recruitment & selection

As the Commission does not provide advice or assistance on this process, some places to find information are listed below.

The Australian Human Rights Commission provides guidelines on best practice recruitment and selection.

Business Victoria has basic tips for small businesses, including an interview techniques video.

The Fair Work Ombudsman has information on its website about what employers should do for a newly recruited employee.

Job Access is a federal government initiative created to find workplace solutions for people with disability and their employers. The site has information on a wide range of employment matters written for:

  • employers
  • job seekers
  • employees with disability
  • co-workers of people with disability, and

Australian Government employment service providers.

Workplace culture

The Commission can't provide you with advice about workplace culture.

The Fair Work Ombudsman provides extensive material about flexible workplace arrangements and other considerations that may impact upon the culture of a workplace. For further information refer to their Best Practice Guides.
