To make an application for a single enterprise agreement, you must complete the relevant forms and lodge them at the Commission. It is common for parties to begin completing these forms during the bargaining process and you may find that this works best for you. However please note that it is not uncommon for forms to change (as well as the content of the agreement during bargaining), so to prevent any delays, please ensure that you lodge the most recent version of the forms when you lodge your application.
To make an application, a Form F16 will need to be completed.
The employer will need to complete a Form F17. The Form F17 asks you to provide information about your agreement and the steps you took before it was made. It is useful to gather together all your supporting material prior to completing the form (eg NERR and copies of explanatory material provided to employees). You will also need to provide your supporting material when you lodge the form.
If there is a union involved in the application, they might like to complete a Form F18.
If there is an employee representative involved in the application, they might like to complete a Form F18A.
Once the agreement has been made, you need to apply to the Commission to have the agreement approved. To do this you must lodge the agreement along with the relevant application forms to the Commission within 14 days of the agreement being made.
