The Commission is a tribunal. To make sure it stays independent, Commission staff and Members cannot provide legal advice. This includes advice on whether you should make an application, which application is the best one for you or how to run your case.
It is not necessary to be represented by a lawyer or paid agent when appearing before the Commission and many parties choose to represent themselves. However, we understand that legal advice can reduce complexity and confusion, improve access to justice and minimise costs. The following services may be able to offer assistance.
The Workplace Advice Service provides access to free legal assistance to eligible people and small business employers who need advice or information about dismissal, general protections and workplace bullying.
The Service is currently available in New South Wales, Queensland, South Australia, Victoria and Western Australia.
