1983 Social Welfare Union Case
The Queen v Coldham & Others; Ex parte The Australian Social Welfare Union (Social Welfare Union Case) (1983) 153 CLR 297 – Gibbs CJ., Mason, Murphy, Wilson, Brennan, Deane and Dawson JJ., Judgment 9 June 1983
In a unanimous judgment the High Court decides to reinstate the interpretation of the term ‘industrial dispute’ to that decided in the 1908 Jumbunna Case. Specifically it calls for a broad interpretation of the term.‘We reject any notion that the adjective 'industrial' imports some restriction which confines the constitutional conception of 'industrial disputes' to disputes in productive industry and organised business carried on for the purpose of making profits,’ the court says.
