Case summary

In response to significant technological and structural changes, the Australian Conciliation and Arbitration Commission establishes a test case standard on employment protection in Australia. The case addresses termination of employment by both employer and employee, the introduction of technological change, and consequential redundancies.The decision provides for notice of termination, consultation on major change and pending redundancies and severance arrangements for employees whose jobs become redundant. It also requires that dismissals by employers not be unfair and not be on discriminatory grounds.
