Construction, Forestry, Mining and Energy Union v The Australian Industrial Relations Commission [2001] HCA 16 (15 March 2001) – Gleeson C.J., Gaudron J, McHugh J, Gummow J, Kirby J, Hayne J and Callinan J, Order 15 March 2001

The High Court confirms Parliament’s power to legislate for parties to confer on the Australian Industrial Relations Commission by a certified agreement a power of private arbitration in respect application of the agreement. In the case of Gordonstone Coal it rules that the Commission was not invalidly exercising judicial power when excercising private arbitration under a certified agreement.
